D8 vs D2 Portugal: Remote Work, Freelancing or Portuguese Business?

D8 is primarily about working remotely for people or organisations outside Portugal. D2 is about independent professional activity or entrepreneurship connected to Portugal.

That distinction sounds simple until the applicant is a freelancer, consultant, founder or company owner.

A person may work online, own a foreign company and still need D8 analysed first. Another person may also work online but be relocating a genuine professional or business activity into Portugal, making D2 the more relevant route.

The correct answer depends on how the work and payments are actually set up, not on whether you call yourself a "digital nomad", "freelancer" or "entrepreneur".

Before you open a company or prepare the visa application, first work out which route actually fits.

The core difference

D8: you keep working for employers or clients outside Portugal

Portugal's remote-work residence visa covers employees and independent professionals who perform their work remotely for persons or organisations domiciled or headquartered outside Portugal.

For D8, you need to show:

  • the remote professional relationship;
  • who pays you;
  • where the employer, clients or business are based;
  • evidence of the activity;
  • recent income from the work;
  • tax residence.

D2: you are setting up independent work or a business connected to Portugal

D2 covers self-employed work and entrepreneurship.

For self-employed applicants, a service contract or written proposal can be central to the application. If the profession is regulated, you also need the required professional qualification.

For entrepreneurs, you need to show what you have already invested or plan to invest in Portugal, what the project is, how long it is expected to run and that you have the money to carry it out.

D2 is therefore not simply "D8 with a company".

When D8 is usually the better starting point

D8 is usually the first route to check when you keep working for employers or clients outside Portugal.

Examples include:

  • an employee of a US company working remotely from Portugal;
  • an independent software developer with foreign clients;
  • a consultant providing services remotely to companies outside Portugal;
  • a founder who performs remote work for their own foreign company and can properly evidence the relationship and remuneration.

The rule requires average monthly income from the remote work of at least four times Portugal's monthly minimum wage.

With Portugal's 2026 minimum wage at €920:

€920 × 4 = €3,680

The test uses the average monthly income earned from the remote work during the previous three months.

This is one reason D8 cannot be assessed simply by looking at annual savings.

When D2 is usually the better starting point

D2 is usually the first route to check when you plan to set up self-employed work or a business activity connected to Portugal.

Examples can include:

  • an independent professional with a Portuguese service project;
  • a consultant establishing real activity in Portugal;
  • a founder creating and operating a Portuguese company;
  • an entrepreneur investing capital into a Portuguese business;
  • a professional whose route is built around a service contract or business operation rather than foreign remote work.

D2 does not require every applicant to form a Portuguese company.

For an independent professional, a service contract or written proposal can be central to the application.

For an entrepreneur, the investment plan, financial resources and credibility of the proposed operation become central.

Freelancer: D8 or D2?

"Freelancer" is not a visa category.

Ask two questions.

1. Who are your clients?

If your clients are outside Portugal and you will continue serving them remotely from Portugal, D8 may fit.

If the professional activity is being established in Portugal, D2 may fit better.

2. What is the project you are actually moving?

If you are moving yourself to Portugal but you keep working for foreign clients or employers, that points toward D8.

If you are moving the activity or creating a Portuguese business operation, that points toward D2.

Example A

A marketing consultant has four clients in the UK and US, keeps the same contracts, works online and has no Portuguese commercial operation.

D8 is the logical route to test first.

Example B

A consultant moves to Portugal to establish a Portuguese professional activity, signs a Portuguese service agreement and intends to invoice from Portugal.

D2 becomes a much more natural route to analyse.

Do you need a Portuguese company for D2?

No, not in every D2 case.

A self-employed D2 case can be based on professional services without a company, if the legal requirements are met.

A Portuguese company can be appropriate for an entrepreneur, founder or business project, but incorporation should not be used as a substitute for route eligibility.

A company certificate by itself does not explain:

  • what the business does;
  • whether the activity is real;
  • whether the applicant has a credible role;
  • whether the project is funded;
  • whether the economic facts support the visa route.

Can a company owner use D8?

Potentially, yes, but the company ownership itself is not the qualification.

The remote-work regulations accept a company contract as one possible form of evidence for independent remote activity.

The analysis should still establish:

  • the applicant's professional role;
  • the foreign company, employer or client;
  • the remote nature of the activity;
  • how remuneration is received;
  • the recent three-month income test;
  • whether the project remains foreign or is effectively becoming a Portuguese entrepreneurial activity.

This is one of the situations where D8 and D2 should be compared before filing.

Does D2 have the same €3,680 income requirement as D8?

No.

The four-minimum-wage income rule is specific to D8.

D2 still requires sufficient means and solid proof of the professional or business activity, but the D8 income formula does not apply to it.

For independent activity, professional contracts and qualification evidence can be central.

For entrepreneurs, authorities look at the investment operation, financial resources and the proposed Portuguese business activity.

D8 evidence

A D8 application normally needs to establish both the professional relationship and the income.

Depending on the applicant profile, evidence can include:

Employee

  • employment contract;
  • employer declaration confirming the relationship;
  • income evidence for the previous three months.

Independent professional

  • company contract;
  • service contract;
  • evidence of services provided to one or more entities;
  • income evidence for the previous three months.

You must also provide proof of tax residence.

D2 evidence

The D2 evidence depends on which branch applies.

Independent professional

The rules refer to:

  • a service contract or written proposal for services;
  • professional qualification where the profession is regulated;
  • general visa documents and means.

Entrepreneur

The application can include:

  • a statement describing an investment already made or intended in Portugal;
  • the nature, value and duration of the project;
  • evidence of financial resources available in Portugal;
  • a clear description of the planned investment.

This is why a generic "business plan" template is not the entire D2 file.

What if you already have a foreign company?

A foreign company does not automatically force D8 or D2.

Three cases are common.

Foreign company, foreign customers, remote activity remains abroad

D8 may be the stronger analysis.

Foreign company is being expanded into Portugal

D2 and corporate structuring may become relevant.

Founder creates a Portuguese company while maintaining foreign activity

The answer depends on which activity is actually supporting your residence application.

Trying to solve this by adding more companies usually makes the application harder, not clearer.

D2 or D8 if you plan to hire in Portugal?

Hiring in Portugal is a sign that the project may be developing a real business activity in Portugal.

That does not decide the visa on its own, but it is a good reason to check whether D8 still matches how the business actually works.

Corporate, employment and immigration planning should be aligned before commitments are made.

What if your business model changes after residence is issued?

Do not assume that the basis of your original residence application automatically covers every later change.

Examples:

  • remote employee becomes freelancer;
  • freelancer starts serving Portuguese clients;
  • foreign-company owner moves operations into Portugal;
  • D2 entrepreneur closes the business;
  • D8 employee loses the foreign job.

A material change should be reviewed against the residence title actually held and the current AIMA procedure.

D8, D2 or D7?

There are three different economic stories.

D7

"I primarily live from my own stable income."

D8

"I actively work remotely for an employer or clients outside Portugal."

D2

"I am establishing independent professional or entrepreneurial activity connected to Portugal."

If you cannot describe your case cleanly using one of those sentences, it is worth checking the route before you prepare the application.

A quick way to choose what to check first

Choose D8 for analysis first if:

  • you have a foreign employer;
  • your clients are abroad;
  • your work is performed remotely;
  • your average income from the remote work meets the D8 threshold;
  • the economic activity remains genuinely foreign-facing.

Choose D2 for analysis first if:

  • you are establishing independent activity in Portugal;
  • you have a Portuguese professional project;
  • you are creating or investing in a Portuguese business;
  • your application is built around entrepreneurship or Portugal-based services.

Have the route checked before filing if:

  • you own the company that pays you;
  • you have clients in several countries including Portugal;
  • you plan to incorporate in Portugal but keep foreign contracts;
  • your personal income and company revenue are being mixed together;
  • your business model will change immediately after moving.
