A habilitação de herdeiros is the Portuguese procedure used to establish who the heirs are after a person dies.
For an international family, it is often one of the first formal steps needed before banks, registries and other Portuguese institutions can deal with the inheritance file.
It does not by itself divide every asset between the heirs. It answers the more basic question first:
who are the people entitled to inherit, and on what succession basis is the Portuguese file proceeding?
When is habilitação de herdeiros useful?
It commonly becomes relevant when the estate includes or may include:
- Portuguese real estate;
- Portuguese bank accounts;
- Portuguese company interests;
- vehicles or other registered assets;
- a Portuguese will;
- a foreign will that has to be used in Portugal;
- heirs living in different countries;
- foreign succession documents that have to be integrated into the Portuguese file.

Who can request it?
The Portuguese procedure can be initiated by the person entitled to act as cabeça-de-casal, by a legal representative or by an authorised representative acting for the relevant party.
For a family living abroad, representation can be important because the practical work may involve:
- obtaining Portuguese registry information;
- filing foreign documents;
- correcting missing evidence;
- coordinating several heirs;
- dealing with banks or registries after the habilitação is completed.
The representative still needs the correct authority and succession evidence. Representation is not a substitute for proving who the heirs are.
What documents are normally relevant?
The exact file depends on the family and on where the death, marriage, births and succession documents were issued.
The core evidence can include:
- death certificate;
- identification and Portuguese tax numbers where required for the procedure;
- birth and marriage records proving family relationships;
- a will, if one exists;
- succession certificates or equivalent foreign evidence where relevant;
- documents identifying the estate assets if registration of assets is requested at the same time;
- proof of the applicable foreign succession law where the Portuguese procedure requires it;
- translations or other document formalities where applicable.
International families should not assume that every foreign document follows the same route. A foreign civil certificate, a court decision and a will may have different evidentiary and formal requirements.

What if the deceased left a foreign will?
The existence of a foreign will can change the evidence needed for the Portuguese succession file.
The correct sequence is not simply:
`foreign will -> apostille -> inheritance complete`
The file may need to establish:
- 1. which succession law applies;
- 2. whether the will is formally and evidentially usable for the matter;
- 3. whether a translation or other document formality is required;
- 4. how the will affects the identification of heirs or beneficiaries;
- 5. how the resulting rights are implemented against Portuguese assets.

Simple habilitação vs habilitação with registration of assets
These are related but different practical outcomes.
Simple habilitação
The core purpose is to identify the heirs.
It is often the foundation needed before other institutions will proceed with the estate.
Habilitação with registration of estate assets
The Portuguese inheritance-service framework also allows the heir-status step to be combined with registration of assets that form part of the undivided estate, where the procedure and evidence allow it.
This can be useful when the relevant Portuguese assets are already known and the objective is to move directly into the registration stage.
It is not a substitute for asset investigation where the family still does not know what exists.
How much does a simple habilitação cost?
The currently published base fee for a simple habilitação is EUR 150.
That is a public administrative base, not the total cost of an international estate.
Additional amounts can arise from:
- the specific procedural variant;
- registry consultations;
- tax or stamp-duty matters;
- foreign-document retrieval;
- translations;
- legalisation where applicable;
- legal representation;
- asset registration;
- later partition or transfer work.
The right way to budget an international inheritance is to map the entire file, not to treat EUR 150 as a complete succession-service price.

Legal Representation Before Portuguese AuthoritiesWhat is the European Certificate of Succession?
For certain cross-border estates involving participating EU states, the European Certificate of Succession can help an heir, legatee, executor or estate administrator prove their status or powers in another participating state.
It can be very useful, but it is not mandatory.
It also does not automatically replace every Portuguese domestic succession document.
Whether it adds value depends on:
- where the deceased lived;
- where the assets are located;
- which states are involved;
- what the bank, registry or other authority needs to see;
- whether the estate needs a Portuguese habilitação for the intended next step.
The practical question is therefore not "Do I always need a European Certificate?" but "Which succession document is the most effective proof for this cross-border asset or procedure?"
Does habilitação mean the inheritance has been accepted?
The concepts should not be confused.
Habilitação establishes the heirs for the Portuguese file. The legal decision to accept or renounce an inheritance is a separate matter with its own consequences.

Before starting, answer these questions:
- Where did the deceased die?
- Where was the deceased habitually resident?
- Was there a will?
- Is the will Portuguese or foreign?
- Which succession law appears relevant?
- Who are the possible heirs?
- Are any heirs minors or represented persons?
- Which Portuguese assets are already known?
- Which assets still need to be investigated?
- Which documents were issued outside Portugal?
- Which documents need translation or another formality?
- Will the heirs act personally or through a representative?
Once these answers are mapped, habilitação becomes part of a controlled succession file rather than an isolated certificate request.
