Inheritance and Gifts During Marriage in Portugal: Who Owns Them?

Receiving an inheritance during marriage does not automatically mean that your spouse owns half of it.

Under Portugal's default regime, `comunhão de adquiridos`, property received by one spouse through inheritance or gift normally remains that spouse's separate property.

But the answer changes under other matrimonial regimes, and separate ownership does not remove every spouse-consent rule.

Under the default regime: inheritance and gifts are separate

Article 1722 of the Portuguese Civil Code treats property received after marriage by succession or donation as separate property under `comunhão de adquiridos`.

So if one spouse receives:

  • money from a parent
  • an inherited apartment
  • shares from an estate
  • a gifted investment
  • land transferred as a gift

the starting point is that the asset belongs to the receiving spouse, not automatically to the marital community.

Under separation of property

Property ownership remains separate.

An inheritance or gift received by one spouse belongs to that spouse unless the gift or succession itself creates co-ownership or names both spouses.

Under general community

General community is broader.

It normally brings a much wider group of present and future assets into the common estate, including assets received without payment.

But Portuguese law preserves defined categories as separate even under general community.

For example, a donor or testator can in certain circumstances impose an incomunicability condition so that the asset remains outside the marital community.

Do not apply the default-regime answer to a general-community marriage.

Can I renounce an inheritance without my spouse?

Not always.

Renouncing an inheritance or legacy requires the other spouse's consent unless the spouses are under separation of property.

This is a good example of why ownership and decision-making are different legal questions.

An inheritance may be destined for one spouse, while Portuguese matrimonial law still gives the other spouse a role in the decision to reject it.

Who manages inherited or gifted property?

The receiving spouse normally has important administration powers over property acquired gratuitously.

But administration does not mean unrestricted disposal of every asset.

If the inheritance includes Portuguese real estate, spouse-consent rules can apply to a later sale, mortgage or lease.

I inherited a Portuguese apartment. Can I sell it alone?

It depends.

Under a community property regime, a sale or mortgage of separate real estate can still require both spouses' consent.

Under separation of property, the owner generally has broader freedom to dispose of separate real estate.

But if the inherited apartment is now the family home, both spouses' consent is required regardless of the matrimonial regime.

What if I use inherited money to buy another asset?

The source of funds matters.

Under the community-of-acquisitions regime, Portuguese law allows separate-property character to continue through substitution.

If inherited money is used to acquire another asset and the intention is to preserve separate status, the provenance of the funds should be documented properly in the acquisition file.

Do not wait until a later divorce or succession dispute to reconstruct that history.

What if the inheritance is cash?

Cash can be legally simple and evidentially difficult.

If inherited money is:

  • mixed into a joint account
  • combined with employment income
  • used partly for family expenses
  • used as a deposit on jointly financed property

the practical evidence trail can become more complicated.

Keep:

  • estate documents
  • bank statements showing receipt
  • transfer records
  • purchase documents
  • documents identifying the source of money used in later acquisitions

What if a parent gives money to both spouses?

Then the recipient question itself changes.

A gift to one spouse and a gift to both spouses are not the same transaction.

The gift document, transfer instructions and surrounding evidence should make the donor's intention clear.

For significant gifts, especially property or investment assets, do not rely on informal family understanding.

Does separate inheritance stay separate on divorce?

Under `comunhão de adquiridos`, inherited property is normally outside the common property to be divided.

But connected financial issues may still exist if:

  • common funds paid for improvements
  • a mortgage was serviced with marital resources
  • inherited money was mixed with common money
  • the asset was replaced by another asset
  • records are incomplete

The classification question should be reviewed before the property division is negotiated.

No.

If the couple has different nationalities, lives abroad or has a foreign matrimonial property regime, do not assume the Portuguese default regime decides every matrimonial ownership question.
