Winning a debt dispute and recovering money are not the same thing.
Portuguese law separates:
- 1. establishing that the debt exists;
- 2. obtaining an executive title;
- 3. enforcing that title against debtor assets.
If you already have an executive title, you may be able to move directly into enforcement.
If you only have an unpaid invoice or disputed contract claim, you normally need another legal step first.
What is an executive title?
Portuguese enforcement is title-based.
Article 703 of the Civil Procedure Code identifies categories of documents that can support execution.
Important examples include:
- condemnatory court judgments;
- qualifying notarial or authenticated documents that constitute or recognise an obligation;
- qualifying negotiable instruments;
- documents given executive force by special law.
The title defines the purpose and limits of the enforcement action.
Is an invoice an executive title?
An ordinary invoice is not automatically an executive title merely because it is unpaid.
It can be evidence of the debt.
But enforcement needs a title recognised by law.
A creditor with only an unpaid business invoice may first need:
- injunção;
- declaratory proceedings;
- another title-generating route.
Injunção as a route to an executive title
Where injunção is legally available, the debtor is notified of the claim.
If the debtor does not oppose after proper notification, the request can receive the enforceability formula.
That gives it executive force.
If the debtor opposes, the debt remains contested and proceeds into the relevant court process.
So injunção is not itself a guarantee of automatic enforcement.
What is a formal enforcement action?
An enforcement action asks the legal system to realise an obligation coercively.
For a money debt, that can include identifying and seizing assets that can lawfully be used to satisfy the claim.
The execution is conducted under the Civil Procedure Code with a central role for the agente de execução.
What does the enforcement agent do?
Portuguese enforcement agents can carry out steps including:
- locating debtor assets;
- consulting legally available databases;
- seizure / penhora;
- sale or realisation of seized assets;
- processing recovered money for creditors.
The agent does not decide the underlying disputed contract case.
The agent executes a qualifying title within the procedural framework.
What is PEPEX?
PEPEX is the Procedimento Extrajudicial Pré-Executivo.
It is a voluntary pre-enforcement procedure.
Its central purpose is to use authorised database searches to identify:
- debtor information;
- potentially seizable assets;
- whether formal enforcement appears economically useful.
PEPEX can be valuable when the creditor has a qualifying executive title but does not know whether the debtor owns reachable assets.
Do you need an executive title for PEPEX?
Yes.
PEPEX is not a shortcut around the need for a title.
The statutory procedure requires a title meeting the applicable conditions.
You cannot take an ordinary disputed invoice to PEPEX and ask the enforcement agent to decide whether the invoice is valid.
First establish the enforceable debt.
What databases can be checked?
Within the statutory framework, the enforcement agent can access relevant databases including information connected with:
- Tax Authority;
- Social Security;
- civil records;
- companies;
- property;
- vehicles;
- enforcement records.
The objective is to identify the debtor and potentially seizable property.
Access is governed by law.
It is not an unrestricted private investigation.
What happens after PEPEX finds assets?
The strategy can move toward formal enforcement.
The PEPEX framework contains a conversion mechanism into an enforcement action where the statutory requirements are satisfied.
Previous asset-location work does not necessarily need to be repeated after conversion.
This can make PEPEX useful as a viability screen.
What if PEPEX finds nothing?
That is economically important information.
The creditor can consider:
- waiting and renewing searches where permitted;
- negotiating;
- insolvency strategy;
- writing off or provisioning the debt;
- checking guarantees or other liable parties.
A court judgment against an assetless debtor can still be legally correct and commercially unrewarding.

Company debt versus gerente liability
A debt owed by an Lda is normally a debt of the company.
A creditor cannot automatically seize the gerente's personal property simply because the company failed to pay.

Guarantees
If a third party gave:
- personal guarantee;
- bank guarantee;
- mortgage;
- pledge;
- other security,
the enforcement strategy may include that security under the applicable rules.
Do not assume the debtor company is the only relevant obligor without reviewing the contract package.

If a company cannot generally pay its debts, insolvency can become more relevant than individual enforcement.
An insolvency process affects:
- creditor ranking;
- asset realisation;
- individual enforcement;
- filing of claims.
The creditor should not continue spending on isolated collection steps without checking whether insolvency proceedings already exist or are likely.
Foreign judgments and titles
If you obtained a judgment outside Portugal, enforcement in Portugal raises an additional recognition / cross-border enforcement question.
EU judgments and non-EU judgments can follow different frameworks.
Do not assume every foreign judgment can be filed directly with a Portuguese enforcement agent.
